New And Expectant Parents

Parents receive a free birth certificate for newborns about four weeks after birth. Your baby’s birth certificate will be based on information you provide at the hospital when you deliver. It will be automatically mailed to the parents listed on the certificate.

At the hospital, you will be asked to fill out a Mother/Parent Worksheet . You can complete this ahead of time and bring it to the hospital or give it to your midwife. The worksheet collects important information and helps your baby get a Social Security Card.

Be careful when you fill out your babys full name and your mailing address. Correcting a birth certificate can cost money or even require a trip to court. A mistake in the mailing address can delay delivery.

An Acknowledgment of Parentage is a document that unmarried parents must both sign voluntarily to establish the child’s legal father/parent.

Certified copies of an Acknowledgment of Parentage are free of charge. Complete the New York State Acknowledgment of Parentage application and submit by mail or in person.

    Article 78 Petition

And so we at Reclaim The Records sued them, and filed the case in the Supreme Court of New York on April 17, 2019.

Affidavit #1 – Roger Joslyn, on the effect of records being withheld in probate, kinship, and other legal matters

Roger Joslyn is a past president of the Association for Professional Genealogists and an expert witness who has been working with New York City vital records for decades. He compares and contrasts the difficulty in getting records in New York City to other areas of the country, where it is far easier.

Affidavit #2 – Megan Smolenyak, on the repatriation of United States servicemembers

Megan Smolenyak’s genealogical work has been on the front page of the New York Times twice. She is a consultant to the U.S. Army who assists them in identifying and locating genetic matches and also the legal next of kin of soldiers killed overseas during WWII and the Korean War, so that they can be brought back to the US for burial.

Affidavit #3 – David Bushman, on the need for records access for family health reasons
Affidavit #4 – Kelly Bodami, on the NYC DOH blocking people from their lawfully entitled citizenship
    The City’s Motion to Dismiss

The city is trying to get the case dismissed. They didn’t make a single argument against the production of the records under FOIL but did try to argue that we couldn’t overturn the rules because the date of our lawsuit was too many months after the rule change was passed.

Ignore The Genealogists At Your Peril

When you read our Petition, youll see quotations from many notable people and venerable societies within the genealogical community, who took the time to give testimony and provide public comments to the Department of Health, carefully documenting all the reasons why these new rules were a very bad idea but who were then totally ignored.

In October 2017, sixty-two genealogists even showed up at a Department of Health public meeting to protest the proposal of these new rules. This was more people than had shown up to any New York City Department of Health meeting on any subject in several years! Every person who gave testimony spoke out against the proposal. Not even one member of the general public submitted a comment in favor of the new stricter rules.

Pictured above: some of the sixty-two genealogists, historians, and adoptee rights activists who protested the proposed rule change at the New York City Department of Health public meeting in Long Island City, Queens, in October 2017.

But the Department of Health didnt listen to the thousands of public comments that poured in, unanimously in opposition to their proposed rule change.

You Might Need A Death Certificate To Obtain Permission To Access Other Records

Aside from the genealogical information, a death certificate is often a very handy tool to have in your arsenal, because it could quite literally be the key to unlocking more recordsin your research, you may need to submit proof that an individual has died in order to obtain records about their life.

For instance, researchers seeking birth certificates and marriage records for ancestors who lived in New York State will need to submit proof of death in order to obtain these records.

For New York State birth certificates, researchers need to prove the individual is deceased. For marriage records, researchers need to prove that both spouses are deceased.

A similar example applies to those researching New York Cityyou will need to submit proof that both spouses have died if seeking a marriage record less than 50 years old.

This reason alone should be enough to motivate you to find that death certificatetheres nothing more frustrating than finding the exact birth or marriage certificate youre seeking, only to realize that you need to hunt down a whole other record in order to be allowed to access it.
